Welcome to the website of Nancy Ebbert Counseling and Consulting (NECC). These Terms of Service (Terms) govern your access to and use of our website (Site) located at nancyebbert.com. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these terms, please do not use the website.

These Terms apply only to your use of the Site. They do not replace or modify any informed consent documents, Notice of Privacy Practices, or other agreement you may sign as a client of our psychotherapy and consulting services.

No Medical or Emergency Advice

The content on the Site is provided for general informational and education purposes only. It is not intended to be, and should not be used as, or as a substitute for:

  • Professional mental health, medical, or psychological advice
  • Diagnosis or treatment
  • In-person or telehealth psychotherapy

Nothing on the Site creates a therapist-client relationship. If you are experiencing a medical or psychiatric emergency, call 911 or your local emergency number immediately, or go to the nearest emergency room where you will be evaluated by a mental health professional. Do not rely on the Site, email or phone number for urgent or emergency needs.

 Therapist-Client Relationship

Visiting the Site, emailing or calling to schedule an initial consultation does not by itself establish a therapist-client relationship with any practitioner. A therapeutic relationship is only formed after:

  • You and the clinician have mutually agreed to work together, and
  • You have signed the required intake, consent, and other practice documents.

We reserve the right to decline or terminate services in accordance with applicable law and professional ethics.

Eligibility to Use the Website

By using the Site, you represent that:

  • You are at least 18 years old, or you are using the Site with the consent and supervision of a parent or legal guardian; and
  • You have the legal authority to enter into these Terms on your own behalf or on behalf of another person for whom you are seeking information.

If you do not meet these requirements, you must not use the Site.

4. Permitted Use and Intellectual Property

All content on the Site, including text, graphics, logos, images, and other materials (Content), is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Site for your personal, non-commercial use; and
  • View, download, or print small portions of the Content solely for your personal, non-commercial purposes.
  • Re-posting on social media and saving to content boards is allowable if full credit is listed and content linked directly back to the site in which it is posted. Credit includes the Website link, author name and any other identifying information provided in the content.

You agree that you will not:

  • Reproduce, distribute, modify, or create derivative works from the Content;
  • Use the Site or Content for any commercial purpose without our prior written consent;
  • Remove or alter any copyright, trademark, or other proprietary notices; or
  • Use any automated means to access the Site (such as bots, scrapers, or crawlers) except as allowed by standard browser tools.
  • Use this Site in any way that impacts user access, is damaging to the Site, or is contrary to any laws and regulations.

User Conduct

You agree not to use the Site in any way that:

  • Violates any applicable federal, state, or local law or regulation;
  • Infringes upon the rights of others, including privacy or intellectual property rights;
  • Is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable;
  • Attempts to gain unauthorized access to any portion of the Site, our systems, or other users’ information; or
  • Interferes with the security or operation of the Site.

Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect information through the Site. The Privacy Policy is separate from our Notice of Privacy Practices, which governs our use and disclosure of protected health information under applicable health privacy laws such as HIPAA.

By using the Site, you consent to our collection and use of information as described in the Privacy Policy.

Disclaimers

The Site and all Content are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Any warranty that the Site will be uninterrupted, secure, or error-free;
  • Any warranty regarding the accuracy, completeness, or reliability of any Content.

We do not warrant or guarantee any outcomes or results from the use of the Site or from engaging in psychotherapy or mental health services with our practice. Individual experiences and results may vary.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, in no event will we or our owners, clinicians, employees, contractors, or affiliates be liable for any:

  • Indirect, incidental, consequential, special, or punitive damages;
  • Loss of profits, revenue, data, or goodwill; or
  • Damages resulting from
    • Your use of or inability to use the Site,
    • Any errors or omissions in the Content,
    • Any unauthorized access to or use of our servers or information, or
    • Any third-party conduct or content.

Our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred dollars (US $100) or the amount you paid to us for Site-related services in the three months preceding the claim, whichever is greater.

Some jurisdictions do not allow limitations of liability for certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Nancy Ebbert Counseling and Consulting, its owners, clinicians, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site or Content;
  • Your violation of these Terms; or
  • Your violation of any rights of a third party.

Changes to the Site and Terms

We may modify, suspend, or discontinue any part of the Site at any time, with or without notice. We may also update these Terms from time to time. When we make changes, we will revise the “Last updated” date at the top of this page.

Your continued use of the Site after any changes to the Terms constitutes your acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Site.

Assignment

NECC is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by the laws of the State of Maryland and applicable federal law, without regard to its conflict of laws principles.

Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to the personal jurisdiction and venue of such courts. If you are located outside the United States, you are responsible for compliance with any local laws that may apply.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of rights must be in writing and signed by us.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms or agreements you enter into with us (such as informed consent forms or Notices of Privacy Practices if you become a client), constitute the entire agreement between you and us regarding your use of the Site.
